Comments Off

Pedestrians killed by hit and run driver near Austin, Texas.

Austin Police released details about the victims and the vehicle involved in the crash on FM 973 near Burleson Road. The victims, Paul Garcia and Kelly Horn were pedestrians. According to reports, Garcia and Horn were walking along FM 973 at about 8 p.m. Saturday when they were struck. Their bodies were found some 12 hours later on Sunday morning. When police arrived they found pieces of a broken headlight and some other evidence from the vehicle that had been involved in the crash. An investigator in the right place at the right time noticed a truck with substantial damage to the front end. The investigator followed the truck to a mobile home park and officers responded to the scene. Police have recovered the car but have not yet made an arrest.

Although no amount of money can repair the damage done to this family, the brutality of this hit & run accident is a wake up call to the rest of us. Despite the fact that establishing who actually caused this collision will be very difficult, the children or heirs of the injured pedestrians may be able to pursue a uninsured motorist claim with the victims’ own insurance company or a neligence claim against the driver once identified.
